ND Forfeiture Law Getting Mixed Reviews

Attorneys, lawmakers, and citizens are weighing in on North Dakota’s new asset forfeiture law, offering cautious praise in some cases (“definitely a step in the right direction,” “certainly more protective for defendants”) and criticizing it in others (“a sham,” “very, very confusing”). The law, which came into effect on August 1, 2019, “requires a conviction, with exceptions, to initiate forfeiture proceedings […] raises the standard of proof for forfeiture [and] requires law enforcement agencies to report forfeitures, among other changes.” Representative Rick Becker, who is critical of the law, believes it doesn’t go far enough to protect citizens from governmental harm.
