The Fargo Forum recently reported that “[c]harges related to the largest drug bust in the history of the West Fargo Police Department have been thrown out after prosecutors decided an officer did not have enough reasonable suspicion to stop the suspect’s car.” An expert for the prosecution had “watched dash camera video from [the arresting officer’s] squad car and determined officers made ‘a bad stop.'” The defense also presented evidence showing the stop was illegal. The case was actually dismissed in December in Cass County court, but the dismissal was not immediately picked up by the media.
This case is in contrast to a 2018 Stutsman County ND case that also involved an arrest for a large amount of controlled substances. That case was dismissed by a judge despite the county’s desire to continue prosecution.
