ND Forfeiture Laws Will Continue to Favor Law Enforcement

“New Department of Justice polices rolling back restrictions on police seizures of cash and property are unlikely to affect North Dakota,” which has what some regard as the nation’s worst forfeiture laws, the Forum News Service recently reported. The state “only requires law enforcement to have probable cause to seize cash or property they believe may have been involved in a crime,” and “[l]aw enforcement agencies in the state are not required to track their seizures.” According to Rep. Rick Becker of Bismarck, who sponsored an unsuccessful bill to change forfeiture laws, “Law enforcement says jump, and the Senate says how high.”
